PURPOSE OF THIS NOTICE

 

Title V of the Gramm-Leach-Bliley Act (GLBA) generally prohibits any financial institutions, directly or through its affiliates, from sharing nonpublic personal information about you with a non-affiliated third party unless the institution provides you with a notice of its privacy policies and practices, such as the type of information that it collects about you and the categories of persons or entities to whom it may be disclosed.  In compliance with the GLBA, we are providing you with this document, which notifies you of the privacy policies and practices of Sumners Insurance Agency.

 

OUR PRIVACY POLICIES AND PRACTICES

 

1. Information We Collect:

We collect nonpublic personal information about you from the following sources:

  • Information we receive from you on applications or other forms

  • Information about your transactions with us, our affiliates, or others

  • Information we receive from a consumer-reporting agency

  • Information we receive from government agencies such as motor vehicle records

Health information if a health release form has been signed by you

 

 

2. Information We May Disclose To Third Parties:

We do not disclose any nonpublic personal information about our customers or former customers to anyone, except as permitted by law.  We do not sell any information collected by us to any third party, marketing firm or list. There are situations in which we may share information to authorized parties: (1) with customer consent; (2) to required parties when processing a transaction; (3) to comply with court orders, laws, and regulations.

 

3. Nonaffiliated Third Parties To Whom Disclosures May Be Made:

We disclose nonpublic personal information about you only to nonaffiliated third parties as permitted by law.

 

4. Our Practices Regarding Information Confidentiality And Security:

We restrict access to nonpublic personal information about you to those employees who need to know that information in order to provide products or services to you.  We maintain physical, electronic, and procedural safeguards that comply with federal regulation to guard your nonpublic personal information.

 

5. Our Policy Regarding Dispute Resolution:

Any controversy or claim arising out of or relating to our privacy policy, or the breach thereof, shall be settled by arbitration in accordance with the rules of the American Arbitration Association, and judgement upon the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

 

6. Reservation Of The Right To Disclose Information In Unforeseen Circumstances:

In connection with the potential sale or transfer of its interests, Sumners Insurance Agency and its affiliates resrve the right to sell or transfer your information (including but not limited to your address, name, age, sex, zip code, state and country of residency and other information that you provide through other communications) to a third party entity that (1) concentrates its business in a similar practice or service; (2) agrees to be Sumners Insurance Agency’s successor in interest with regard to the maintenance and protection of the information collected; and (3) agrees to the obligations of this privacy statement.

 

 

7. Our Policy Regarding Use Of Our Website:

 

Our website visitors remain anonymous. We do not collect personal identifying information from website visitors unless they choose to provide such information to us.  In an effort to better serve our customers, the following non-identifying information about our website visitors is collected and stored: (1) the name and internet site provider from which the Internet has been accessed; (2) the date and time the site was accessed; (3) the internet address of the web site from which website visitors linked directly to our site. By using our website, you consent to this policy.  If you do not consent, then please stop using the site.  Our website is not intended for children, and we do not knowingly collect personal information from minors. If we discover or are made aware of the collection of information from a minor, we will take steps to delete such information.

 

This information is not an offer to sell insurance. No binder, insurance policy, change, addition, and/or deletion to insurance coverage goes into effect unless and until confirmed directly with a licensed agent. Note any proposal of insurance we may present to you will be based upon the values developed and exposures to loss disclosed to us on this online form/application and/or in communications with us. All coverages are subject to the terms, conditions and exclusions of the actual policy issued. Not all policies or coverages are available in every state.

8. Ordering of Motor Vehicle Record (MVR) Reports:

Under certain circumstances, we may order MVR reports in accordance with the Fair Credit Reporting Act (FCRA).  As a recipient of this consumer report, we intend to use the information in connection with the underwriting of insurance involving the consumer, and do not share or otherwise disseminate the report in whole or in part to anyone except the insurance company represented in the transaction. In the event of adverse action (i.e. the insurance company excludes the driver), the consumer has rights under the FCRA.

1. Statement of Our Duties:

We are required by the Health Insurance Portability and Accountability Act of 1996 to maintain the privacy of your personal health information and to provide you with this notice of our privacy practices and legal duties.  We are required to abide by the terms of this notice.  We reserve the right to change the terms of this notice and to make any new provision effective to all of the personal health information that we maintain about you.  If we revise this notice, we will post the revised notice on our web site.

 

2. Statement of Your Rights:

You have a right to know how we may use or disclose your personal health information. This notice informs you of those uses and disclosures.  There are certain uses and disclosures of your personal health information that we are permitted or required to make by law without your permission.  For all other uses and disclosures, we first must obtain your permission.  In addition, you have the following rights:

 

  • The right to request that we place additional restrictions on our uses and disclosures of your personal health information (beyond what the law requires), but we are not obligated to agree to any such additional restrictions.

  • The right to access, inspect and copy the protected information pertaining to you that we maintain in our files about you, and the right to have us correct or amend any information that we create in error.

3. Permissible Uses and Disclosures of Protected Health Information

 

  • Payment Functions.  We may use or disclose your health information without your permission to carry out activities relating to reimbursing you for the provision of health care, obtaining premiums, determining coverage, and providing benefits under the policy of insurance that your are purchasing.  For example, payment functions may include (but are not limited to) reviewing health care services with respect to medical necessity, coverage under the policy, appropriateness of care, or justification of charges.

  • Health Care Operations. We also may use or disclose your protected health information without your permission or carry out certain insurance-related activities.  These activities include using your protected information for underwriting, premium rating, or other activities relating to the creation, renewal, or replacement of another contract of health insurance, and ceding, securing, or placing a contact for reinsurance of risk relating to claims for health care.

  • Uses Permitted/Required by Law.  We also may use or disclose your protected health information without your written permission for purposes permitted or required by law.

  • Authorized Uses.  All other uses or disclosures of your protected health information will be made only with your written permission, and any permission that you give us may be revoked by you at any time.

 

4. Complaints About Misuse of Health Information

You may complain either directly to us or to the Secretary of Health and Human Services if you believe that your rights with respect to our protection of your health information have been violated.  To file a complaint with us, you may submit a complaint in writing that includes as many details (names, dates, description of events, etc.) as possible.  You should then mail the complaint to the contact person identified in the next numbered paragraph.  You will not be retaliated against in any way for filing a complaint.
